Acceptance of Terms and Conditions

When you access use or download the services and/or applications offered on this Site or in partner sites or on other realms, including but not limited to the mobile messaging and contests hereby to be collectively named the "Services", you acknowledge that you have read and agree to be bound by the terms and conditions described herein (the "Terms and Conditions"). Issues concerning collection and use of information by Zlango are described in Zlango’s Privacy Policy. Zlango reserves the right to modify, alter and altogether remove specific services or applications on the Site and/or on any of the Services, including, without limitation, the Materials or Content (both terms defined below), at any time without notice. . Furthermore, Zlango may stop providing any Services or any applications, options or materials on the Site at any time. Zlango is allowed to refuse any use of its Site and/or Services, including but not limited to deleting malicious messages, at Zlango’s sole discretion.

Messaging Service

When you accept the Terms and Conditions by joining one of the Services provided in the Site, or, alternatively, by downloading Zlango mobile application to a mobile phone and/or to an applicable handset from other sources - particularly those which require downloading a software - you hereby agree to receive from time to time SMS’s and ZMS’s messages from the operators of the Site and/or the Zlango mobile application, you hereby agree that the application may read all of the contact (address) data stored on your device and use this information to send you updates regarding any of your contacts who have also downloaded the application, and you hereby agree you will not have any claims and/or demands regarding such messaging service. Registration

Providing Zlango with incorrect information will prevent the user from the possibility of using the Site and/or the Zlango mobile application and/or Services. Zlango is also allowed to revoke your ability to use the Site and/or the Zlango mobile application and Services for any reason, and especially when one or more of the following takes place: a. If incorrect information is entered. b. If your registration has damaged and harmed Zlango or its affiliates, or has in it the power to do so. c. No Warranty

Your use of the Site and/or the Zlango mobile application and/or Services is at your sole risk. Zlango disclaims all representations or warranties, expressed or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, with respect to the use of the Services. Zlango does not warrant or represent that the Services and/or the Materials and/or the Zlango mobile application will be uninterrupted, error-free or without defects. To the fullest extent permitted by applicable laws, Zlango and/or its suppliers are not liable for any direct, indirect, special, incidental, consequential or exemplary damages or losses of any kind whatsoever, whether in any action in contract, tort (including but not limited to negligence), or otherwise, resulting to you or any third party, arising out of or in any way connected with: (i) the use - or the inability to use - this Site and/or the Zlango mobile application and/or the Services and/or the Materials provided on this Site and/or on the Zlango mobile application; or (ii) any claim attributable to errors, omissions, or other inaccuracies in the the Zlango mobile application and/or Services and/or the Materials and/or on the Site or available through the Site or through the Zlango mobile application; or (iii) negative or other affects which may have been caused by potential interruptions to and of the Services and unavailability of Materials. This includes but is not limited to the loss of data, loss of profit, goodwill or other losses or damages of any nature, even if Zlango was advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold Zlango, and its subsidiaries and affiliated companies, and each of their respective officers, directors, employees, shareholders, attorneys and agents, harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the Site and/or the Zlango mobile application and/or Services, your use of the Site and/or the Zlango mobile application and/or the Services, your connection to the Site and/or the Zlango mobile application and/or the Services, your violation of the Terms and Conditions, or your violation of any rights of another. In addition, you will indemnify Zlango, its employees, managers and other officers of Zlango, for any claim, lawsuit or demand which will be brought against them by a third-party, as a result of the Content you have provided to Zlango for the purpose of making such Content public.

Governing Law and Jurisdiction

Your use of the Site and/or the Zlango mobile application and the Services and these Terms and Conditions shall be governed in all respects by the laws of the State of Israel, without giving effect to its conflict of laws provisions, the applicable courts of the Tel-Aviv Jaffa district shall have exclusive jurisdiction. If you access this Site and/or download the Zlango mobile application from another jurisdiction, you are responsible for ensuring compliance with any local laws relating to access and use of this Site and/or the Zlango mobile application and the Services provided through the Site and/or the Zlango mobile application.

Miscellaneous

Zlango’s failure to insist upon or enforce strict performance of any provision of this Terms and Conditions shall not be construed as a waiver of any provision or right. The Zlango Site and/or Zlango Mobile application collects user submitted information such as name, telephone no. and email address to authenticate users for login, and to enable email and/or tsxt messaging communication between user and his/her Zlango friends within the Zlango network. Zlango will not provide personally identifiable information to third parties.

Zlango also logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from users and visitors to the Site and/or Zlango Mobile application. This data is used to manage the website and/or the Zlango Mobile application , track usage and improve the website and/or application services. Aggregate data may be shared with third-parties. User IP addresses are recorded for security and monitoring purposes only. Zlango will not provide non-personally-identifiable information to third parties.

Coarse (network-based) location: Access coarse location sources such as the cellular network database to determine an approximate device location, where available.

Your Messages

Read SMS or MMS: Allows the application to read SMS messages stored on your device or SIM card.
Receive MMS: Allows the application to receive and process MMS messages.
Receive SMS: Allows the application to receive and process SMS messages..
Edit SMS or MMS: Allows the application to write to SMS messages stored on your device or SIM card.

Network Communication

Full Internet access: Allows the application to create network sockets.
